Lawyers representing California argued that these officials correctly applied the Harris-Rabinowitz rule, a universally applicable search and seizure principle consisting of the United States v. Rabinowitz and the United States v. Harris case. Most of the opinions in these cases together indicate that officials can conduct searches outside the arrested person. For example, in Rabinowitz, the police arrested a person in a room office and searched the entire room, including the contents of the drawer. In each case, the court maintained the officer’s ability to search the location of the arrest and seize anything related to the crime. Chimel’s lawyer argued that the search violated Chimel’s Fourth Amendment protection because it was based on an arrest warrant rather than a search warrant. The officers have enough time to get a separate search warrant. They waited for several days before making an arrest warrant. In the 7-2 decision, Judge Potter Stewart published the opinion of the court. Finding Chimel’s home is not an “arrest incident.” The Supreme Court rejected the Harris-Rabinowitz rule, which was considered a violation of the basic intent of the Fourth Amendment. According to most cases, officials violated Chimel’s Fourth Amendment. When they conducted illegal searches and seizures on a case-by-room basis, they searched his home without a valid search warrant. Any search should be more limited.
